Is it illegal to take photographs of store’s display windows?
Like how they have mannequins wearing some outfit in a display on the side of a department store. Say I like something and take a photo of it. To see if it will match my wardrobe or not, decide to get it blah blah blah.
Is it legal to do this?
If it’s not legal, why is it illegal?
I’m in the USA.
There is nothing criminal about it. You’re not going to be arrested or anything. However, if you were to take pictures and use them for profit without permission of the store’s owner, you could be civilly liable for “damages”. Although it’s a stretch, you could also be liable to the clothing designer. Again, the liability should only be an issue if you use the images for profit. Even then, it would likely depend on if you published and profited from the images yourself. If you were to sell the images to a third party, the third party would have the ultimate responsibility of obtaining any necessary permission and releases.
